TERMS & CONDITIONS
As a Training Solutions Customer you agree to these Terms and Conditions. In these Terms and Conditions:
● ∙ 'Service', 'Services' means any service that is provided by Training Solutions including but not limited to training courses.
● ∙ 'We' and 'Us' and 'Our' means Training Solutions. ● ∙ 'You' and 'Your' means a Customer.
● ∙ 'Website' means the Training Solutions website at URL www.trainingsolutions.co.nz;
● 'Customer', ‘Customers’ includes any person registering for a service from Training Solutions.
**Changes to Terms and Conditions **
We reserve the right to update these Terms and Conditions. Cancellation or rescheduling of training courses and/or booked services may be made over the phone with our team but must be confirmed in writing to email@example.com. Refund and Cancellation Policy fees are based on full course costs and will be incurred on the following basis:
Where you have given notice to Training Solutions:
● At least 7 working days’ prior to scheduled training or booking - No cancellation fee / 100% refund if pre-paid.
● 3-6 working days’ prior to scheduled training or booking - 50% cancellation fee / 50% refund if pre-paid
● Less than 2 working days’ prior to scheduled training or booking - 100% cancellation fee / NO REFUND if pre-paid.
**Rescheduling Policy fees are based on full course costs and will be incurred on the following basis: **
● At least 7 working days’ prior to scheduled training or booking - No reschedule fee
● 2-6 working days’ prior to scheduled training or booking - 50% reschedule fee
● Less than 2 working days prior to scheduled training or booking - 100% cancellation costs apply. No refund given
Failure to attend training Failure to attend a course will result in a ’No Show’ attendance status. All ‘No Shows’ will be charged 100% cancellation fee. No refund will be given.
Trainee Withdrawal Where a Trainee decides to withdraw from one of Training Solutions courses after course commencement, no refund will be given. Training Solutions will not be liable for any costs incurred by the Customer due to cancellation arising from circumstances beyond our control including but not limited to Trainer illness/weather. Training Solutions reserves the right to cancel any public course if the course has not reached its minimum number.
Group Booking Discounts If the Customer has made a booking for a specific course where a group discount applies, the discount shall only apply if the specified number of employees have attended. If the minimum number for group discount has not been reached, the standard list price will be charged per employee. All ‘No Shows’ will be charged in full.
Training Solutions Withdrawal Withdrawal by Training Solutions is defined by NZQA as voluntary or regulatory closure, insolvency, ceasing to offer an enrolled course, or withdrawal or accreditation or course approval by NZQA.
Course/Training Schedule The availability of courses and dates published on the Website are subject to change without notice. We reserve the right to cancel or alter the dates of any ‘open’ courses due to insufficient numbers of Trainees. We reserve the right to suspend training where continuing would breach the Health and Safety at Work Act 2015 (“HSWA”), or where continuing might place Trainees at an unacceptable level of risk. We reserve the right to refuse to train any person who is deemed by us to be unfit due to health reasons including but not limited to intoxication or behavioural issues. We reserve the right to refuse to train any company, employee or individual who we reasonably believe may be in competition with us. Course duration may vary based on number of Trainees attending and level of knowledge and / or experience.
Late Trainee Arrival Within 15 minutes of scheduled start time: Trainees may remain on course only at the trainer’s discretion. Over 15 minutes of scheduled start time: Trainees may not attend the course and will be charged in full. Should it be necessary for the Trainee to return to complete the course at a later date due to late arrival issues, the initial course and rebooking will be charged at full price.
Company Specific Courses If training is held at the Customer’s premises, the Customer agrees to provide all facilities including but not limited to; machinery, training room, air-conditioning / heating, bathroom access, power outlets, tables, chairs, whiteboard, projector screen/white wall, and tea/coffee facilities. The Customer also agrees to pay the minimum daily rate for the specific course regardless of how many employees attend. Minimum daily rates are subject to course type and length. Customer specific / HSE requirements may be subject to administration charges.
Safety Gear and Personal Protective Equipment (“PPE”) In accordance with the HSWA, all Trainees are required to comply with any instruction, policy or procedure issued by Training Solutions in relation to the use of PPE. This includes, but is not limited to, the wearing of hard hats, high vis vests, harness’s (where applicable) and safety footwear. Failure to comply may result in a Trainee being removed from the course in the interest of safety. Should it be necessary for the Trainee to return to complete the course at a later date, the initial course and rebooking will be charged at full price.
Special Requirements: Prior to course commencement, Training Solutions must be advised if the Trainee has any special requirements including but not limited to health, literacy and cultural requirements. Where a reader/writer is required, it is the Customer's responsibility to supply one. The reader/writer cannot be another Trainee attending the same course or a family member.
**Payment Terms **
**'ON ACCOUNT' – **
The Customer agrees to make full payment for services on 20th of the month following the date of the course unless you have agreed approved payment terms with Training Solutions. Training Solutions reserves the right to charge the customer interest of 5% per month on all overdue amounts at Training Solutions’s discretion. The Customer agrees to pay Training Solutions all agency collection fees associated with the collection of an unpaid debt.
‘On Pre-payment’- The Customer agrees to make full payment for services at the time of booking.
The Customer agrees to make full payment prior to attending the course. The booking/space is not secured until full payment has been received by Training Solutions. The Customer agrees to pay Training Solutions all agency collection fees associated with the collection of an unpaid debt. CARDS/CERTS: These will not be released until payment is received in full. Prices and Additional Fees The prices published on the Website are subject to change without notice unless you have an agreement with us stating otherwise. The Customer agrees to pay any additional costs incurred by Training Solutions, such as travel and accommodation when local resources are unavailable. These charges will be charged at cost to the Customer and will be advised at point of booking.
NZQA Framework Registration We will upload credits to the NZQA Framework within 90 days’ following course completion based on awarded competency.
Trainee Progress / Requirement for Completion Learning objectives are detailed at the beginning of each training module and assessment is conducted throughout the course. A practical assessment may also be conducted on some courses. Trainees will be required to achieve the required level of competency in all areas of the assessment to be awarded the unit standard(s) and credits. Assessment is conducted in compliance with competency based assessment according to NZQA criteria.
**Course Prerequisites ** The Customer accepts full responsibility for failure to abide by any course prerequisites. This includes, but is not limited to, completing and returning course paperwork, evidence of competency, attestation forms. Failure to meet the prerequisites will result in additional fees. Prerequisites are outlined on our website, course information sheets and course confirmation letters.
Attestation Forms Where an Attestation Form is required, the Trainee will have a timeframe given from the date of the course to complete and return the form to Training Solutions . Failure to return a completed Attestation Form before the due date may prevent the unit standard being processed as competent.
Funded Courses Training Solutions accepts no responsibility for the withdrawal of any funding or subsidies. In the event that funding or subsidies are withdrawn, or the Customer is found not to be eligible for the funding or subsidy, Training Solutions will invoice the Customer the full course cost and the Customer remains liable for that amount.
